Foreign nationals who have temporary legal status in the United States may qualify to apply for an adjustment of status (AOS) to become a permanent legal resident. There are many advantages to obtaining permanent legal status in the U.S., such as the right to remain in the country indefinitely and eventually apply for citizenship. To be eligible, you must be physically present in the United States and meet other specific requirements.


Intending immigrants can apply for a family-based adjustment of status based on certain family relationships with a U.S. citizen or lawful permanent resident. Applicants must be physically present in the U.S. and meet other requirements, including:

Maintain Legal Status in the United States: You must have entered the country legally through a valid visa (or the Visa Waiver Program), and your legal status must be maintained.

Clean Criminal and Employment History: You must have no history of criminal activity or unauthorized employment activity.

No Prior or Pending Deportation/Removal Proceedings: You must have no prior history of ICE detentions or deportation or removal proceedings, and no proceedings that are currently pending.

Meet the Requirements for the Visa Category for Which You are Applying: You must demonstrate that you are eligible for an adjustment of status based on the type of family visa you are applying for and continue to meet those requirements throughout the AOS process.

Waivers: You may be eligible for a waiver if you do not meet all the the above requirements.

Certain foreign nationals may also qualify for an adjustment of status based on specific circumstances. These may include those eligible under Deferred Action for Childhood Arrivals (DACA), the Legal Immigration Family Equity (LIFE) Act, the Nicaraguan Adjustment and Central American Relief Act (NACARA), the Violence Against Women Act (VAWA), and on humanitarian grounds for refugees seeking asylum.
